Deferred Action processing update: our immigration law firm can confirm that in some cases, the USCIS is approving the I-821D (deferred action) and I-765 (employment authorization) applications at the same time. Today we received several approvals which have been pending for 47 days.
According to USCIS officials, the Proposed Rule on Provisional Unlawful Presence Waivers (also known as the Stateside Waivers of Unlawful Presence) is expected to be published in the Federal Register by the end of the calendar year 2012. The immigration agency is preparing a field guidance and training manuals, and expects that adjudication standards will be very close to those currently in place for centralized I-601 waivers.
According to USCIS, the agency has approved close to 4,600 Deferred Action requests by eligible applicants. By October 12, 2012, the immigration agency received nearly 180,000 applications (I-821D with I-765), and has over 6,400 of them under review.
