T Visa – Victims of Human Trafficking

What is a T visa?

The T nonimmigrant status (T Visa) helps victims of a “severe form of trafficking in persons” by offering them protection for assisting in identifying, investigating, or prosecuting human trafficking, with some exceptions available.

For T visa eligibility, you must have been the victim of a “severe form of trafficking in persons,” which, under federal law, are:

  • Sex Trafficking
  • Labor Trafficking

Applying for a T visa

To apply, you must submit Form I-914, Application for T Nonimmigrant Status, and all the appropriate documentation to U.S. Citizenship and Immigration Services (USCIS). We strongly encourage you to seek assistance from an immigration attorney when completing and applying for a T visa to reduce the risk of your application being denied.

How long can I stay while on a T visa?

One of the benefits of the T visa is that it allows individuals to stay in the United States for four (4) years, with the option to apply for permanent residence (green card) after three (3) years on a T visa. Employment Authorization (work permit) is also available for T visa applicants.

Can I bring my family while on a T Visa?

Qualifying family members are also eligible for T visa benefits. Regardless of age, you may apply for the following family members if they are in present danger stemming from your escape from trafficking or cooperation with law enforcement:

  • Parents
  • Unmarried siblings under 18 years of age
  • For family members, children of any age or marital status granted T nonimmigrant status.

If your family members are not in present danger, the following list shows who is eligible for T visa benefits depending on the age of the petitioner:

Petitioner Under 21 years of age:

  • Spouse
  • Children
  • Parents
  • Unmarried siblings under 18 years of age

Petitioner 21 years of age or older:

  • Spouse
  • Children
