EB-3 Professional, Skilled, Unskilled Workers
What is an EB-3 visa?
The EB-3 is a third preference visa for skilled workers, professionals with bachelor’s degrees, and unskilled workers. Each category has within the EB-3 visa has its requirements:
- Professionals
- S. baccalaureate or foreign equivalent degree
- Be performing work for which qualified workers are not available in the United States
- Skilled Workers (requires at least two (2) years training or experience)
- Demonstrate at least two (2) years of job experience, education, or training
- Relevant post-secondary education may be considered as training
- Be performing work for which qualified workers are not available in the U.S.
- Other/Unskilled Workers (requires less than two (2) years of experience)
- Demonstrate the ability to perform unskilled labor that is not of a temporary or seasonal nature.
- Be performing work for which qualified workers are not available in the U.S.
Note: Labor certification will be required for EB-3 applicants.
Applying for an EB-3 visa
To obtain EB-3 visa, the employer would need to file a Form I-140, Immigrant Petition for Alien Workers.
Can my family accompany me?
If the I-140 petition is approved, your spouse and unmarried children under the age of 21 could be eligible to live with you in the U.S. under the following categories:
- R34 – spouse of a “skilled worker” or “professional”
- EW4 – spouse of an “other worker”
- E35 – child of a “skilled worker” or “professional”
- EW5 – (child of an “other worker”
