What is a permanent labor certificate?

The Department of Labor (DOL) issues a permanent labor certification that allows employers to hire foreign workers for permanent employment in the United States. The employer must show that they could not find qualified, able, and available candidates for the position.

Applying for a PERM labor certificate

The application process involves gathering information about the job offer and qualifications of the prospective worker. The process includes:

  1. Identifying the job requirements
  2. Prevailing Wage Determination
  3. Recruiting efforts
  4. Reporting the recruitment results
  5. Filing the labor certification application (ETA Form 9089)
  6. Approval/Denial
